Ezen levelet úgy a hazai mint a nemzetközi sajtó figyelmébe ajánljuk, valamint az itt leírt tények kivizsgálására nemzetközi segítséget kérünk az Európai Parlamenttől, továbbá Oroszországot mint a térség nagyhatalmát arra kérjük, hogy vesse latba befolyását az esetleges törvénytelenségek felderítésében.

 

Ugyanis ha a jogtiprásokra belátható időn belül, megfelelő jogorvoslat nem születik az már nem csak Magyarország belügyét képezheti, hanem annak határain túlra is kiterjedhet.

Ezen nemzetközi segítségre való felhívásunk történik azon okból kifolyólag, hogy úgy érezzük hazai porondon szervezetünk mindent elkövetett, amit a törvénytisztelő magatartás keretei biztosítottak.

 

Az utóbbi években Magyarországon a bankok, a hazai fizetőeszköz hitelezését, valószínűsíthetően mesterségesen, olyan előnytelen feltételekkel kínálták a polgárok számára, az úgynevezett devizahitelekkel szemben, hogy gyakorlatilag az elmúlt fél évtizedben nagy többségében „nagyon kedvező” feltételekkel, csakis deviza alapú-nak hirdetett hitelek kerültek kiközvetítésre. Ezeknek többsége CHF elszámolás alapján  történt, mert mint mára bebizonyosodott, ezek a hitelek csak az elszámolási nyilvántartásokban deviza alapúak. A hitelt nyújtó bankok ezen hitelek folyósításakor, ténylegesen nem vásároltak devizát és a visszafizető részletek mellett nem is tartalékoltak devizát, illetve nem vásárolnak devizát a részletek visszafizetésénél. Ezek a hitelek mindig is forint hitelek voltak, forintban lettek kifolyósítva és forintban vannak törlesztve, viszont devizában vannak nyilvántartva anélkül, hogy árfolyam veszteségeik keletkeznének, amely nem létező árfolyamveszteségeket könyörtelenül az Adósokra hárítják. A hitelszerződések  súlyosan, szándékosan egyoldalúak, méltánytalanul előnytelenek az Adósok számára.

 

A Banki Adósok Érdekvédelmi Szervezete (BAÉSZ)már 2009-ban többszöri alkalommal fordult ez ügyben a Bankszövetséghez, a Pénzügyminisztériumhoz, a Kormányhoz, a fogyasztóvédelemhez és az akkor még ellenzéki pártok vezetőihez, akik már azóta 2/3-os többséggel a hatalom kizárólagos gyakorlói.

Ezen beadványainkban arra is felhívtuk a figyelmet, hogy több mint egy millió család létbiztonságának veszélyeztetése, súlyos csalások következménye. Ugyanis a hitelek felvételének időszakában a hitelfelvevők nem tudták felmérni az ország valós gazdasági állapotát, amely gazdasági állapot egyenesen kihat a pénzügyi folyamatokra, ezáltal a hitelek  visszafizetési lehetőségeire is. Ugyanis az akkori kormány meghamisította a gazdasági mutatókat, az őket kiszolgáló média dübörgő gazdaságról számolt be. Mára már köztudott, hogy a nemzetközi „gazdasági válság” nem okozója, csupán leleplezője volt a hazai állapotoknak. A miniszterelnök kiszivárogtatott Öszödi beszéde is azt bizonyította, hogy hazudtak éjjel és nappal hogy elrejtsék a valós állapotokat a választók elől, de a választók egyben a hitelfelvevők is, akik ilyen hazugságok árnyékában hoztak tíz vagy húsz évre szóló döntéseket.

 

A magyar jogban a csalás büntette akkor valósul meg, ha az áldozatot tévedésbe ejtik, tévedésben tartják és ebből kifolyólag anyagi kára keletkezik. Mindez az előbb felsorolt esetből megvalósult, de Magyarországon nincs az úgynevezett politikai felelősségre vonás lehetősége, bár véleményünk szerint ez közönséges köztörvényes csalásnak kellene hogy minősüljön.

Pontos számadatokkal nem rendelkezünk, de több öngyilkossági esetről is tudomásunk van, amelyek ezen okokból való kilátástalanságból fakadtak, anélkül hogy személyi felelősségek megállapításra kerültek volna.

Ugyanúgy eredménytelenül záródtak azon próbálkozásaink is, hogy a magáncsőd intézményének a bevezetését a törvényalkotók soron kívül napirendre tűzzék.


A jelenlegi többségi kormánytól is mindössze annyi tellett, hogy csakis a bankoknak kedvező, az Adósoknak a végső döfést megadó árfolyam befagyasztási intézkedést terjesszenek elő, ami csakis kizárólag arra jó, hogy a csőd előtt állók haláltusáját kitolja három évig, ugyanis a bankok az árfolyam különbözetet egy elkülönített számlán, kamattal terhelve vezetik és az árfolyam

rögzítésének lejárta után az Adósok mindezen különbözetet kamatostól vissza kell fizessék, valójában még több terhet róva rájuk, látszólagos segítségnek álcázva és a tömeges csődhullámot ezáltal szétoszlatva. Így azok akik már most is becsődölnének még három évig fizetnek a banknak amely majd három év múlva ugyanúgy kifosztja az Adóst mindenéből.

A virtuális árfolyam különbségekből adódóan, a bankok által értékbecsült és jelzálogként elfogadott ingatlanok mára már nem fedezik a valójában soha fel nem vett összegeket, ezért a bankok által ilyen-olyan faktoring cégeknek átadott ingatlanok, jóval piaci ár alatt kerülnek kalapács alá, úgy hogy az Adós nem csak az eddig befizetett törlesztéseit és az ingatlanját veszíti el, hanem akár több millió forint, soha fel nem vett összeg hátralékkal is maradhat és ez a  a jellemző. Ezen virtuális többletköveteléseket a bankok, az adósok jövedelméből tiltja le akár több évig vagy évtizedig a magáncsőd intézményének hiányában, amelynek megalkotására egyelőre Magyarországon nincs politikai akarat, amely tény is bizonyítja a politikai réteg és a háttérhatalmi pénzvilág maffiaszerű összefonódását. Az ilyen embertelen intézkedések következtében az Adósokat nem csak több évi munkájuk gyümölcsétől fosztják meg, hanem a legális munkába való részvételtől is mivel 30%-40%-os fizetés letiltással Magyarországon képtelenség családot eltartani.

 

Magyarországon ugyancsak nem rendelkezünk csoportos perindítási lehetőséggel, amely törvénytervezetet a volt Köztársasági Elnök nem fogadott el és visszaküldte megfontolásra, mondván hogy visszaélésekre adna lehetőséget. Tette mindezt ugyanazon a napon amikor azzal együtt a holokauszt tagadásról szóló törvény is asztalára került amelyet elfogadott, az visszaélésekre okot nem biztosíthatott és azóta is mindannyian rendkívül fontosnak tartunk, mert valószínűsíthetően több tagadó van ebben az országban mint banki károsult. Viszont sajnálattal tapasztaljuk, hogy azóta sem került újból napirendre a visszaélésekre okot adó törvény tervezet. Ennek hiányában nem marad más hátra mint erőinket szétaprózva felvenni a küzdelmet a bankokkal szemben . Két éve a BAÉSZ elnöke polgári peres úton pert indított Magyarország legnagyobb bankja ellen, amely per két év után szinte még mindig a perelhetőségi megállapítás szakaszában van. A kilátások érzékeltetésére ismertetni kívánjuk azon tényeket, hogy a bank rosszhiszemű, tárgyalást hátráltató és akadályozó magatartást folytat, amelyért a bíróság több alkalommal is mulasztási bírsággal sújtotta, de előfordult az is, hogy az alperes bank elismerte mulasztását de ennek ellenére méltányossági alapon kérte a bírság elengedését, amelyet a másodfokú bíróság jóváhagyott és annak fellebbezési költségeit, az ügyben vétlen felperesre rótta nyolc napon belüli kifizetési kötelezettséggel, úgy hogy fellebbezésnek helyet nem biztosított.

Meglátásunk szerint mindezen törvénytelenségek és időhúzások arra szolgálhatnak, hogy megakadályozzák a per nemzetközi bíróság elé vitelét amilyen hosszú ideig csak lehet, tudván azt hogy egy esetleges csőd bekövetkeztével együtt a jogi lehetőségek tárháza is erősen megcsappan.

 

Mielőbbi nemzetközi kivizsgálását kérjük annak, hogy megállapításra kerüljön, hogy valójában-e deviza alapú hitelek voltak kiközvetítve és ezáltal jogosak-e az elvárt és behajtott árfolyam különbözetek, vagy csak fiktív, virtuális elszámolás alapján, soha el nem végzett ügylet után szedik be a bankok a törvénytelen módon hatalmas, meg nem érdemelt haszonnal a törlesztéseket, ezáltal koldusbotra és kilátástalanságba kergetve ember milliókat, téve mindezt a mindenkori kormányok asszisztálásával.

A megfelelő törvények hiánya, azoknak meg nem alkotása vagy a meglévőknek nem mindenkire egyformán való alkalmazása, megfosztja az átlag embereket az őket megillető jogi úton való igazság kereséstől.

 

Addig amíg egy ilyen perben egy év csak azzal telik el, hogy a bíróságok sorra megállapítják illetékességüknek hiányát, elkallódott periratokra hivatkoznak, az Adósokat háromszor is kilakoltathatja a bank.

 

Félő, hogy nemzetközi nyomás és a helyzet megfelelő átvilágítása nélkül, az embereknek nem marad más választása, látván azt, hogy a törvénytisztelő magatartás olyan útvesztőkbe süllyed, amelyek a teljes ellehetetlenüléshez vezetnek, ezáltal a kétségbeesett helyzetek kétségbeesett reakciókat fognak kiváltani és mint utolsó önvédelmi eszközhöz, az erőszak alkalmazásához fognak folyamodni családjuk védelmében. A kormány valószínűsíthetően ezt nagyon jól tudja és ezért költ milliárdokat a válság ellenére, terrorelhárító szervezetek felállítására, egy olyan országban ahol a terrorizmus ismeretlen fogalom, ha eltekintünk Matuska Szilveszter 1931-ben végrehajtott egyéni akciójától.

 

A több nyelvre lefordított, az orosz miniszterelnöknek, az európai parlamentnek és a nemzetközi sajtónak is eljuttatott nyílt levél célja a jogi segítség kérés és egyben figyelmeztetés is azok számára, akik a közeljövőben üzleti kapcsolatba akarnak lépni az érintett Magyarországi bankokkal , hogy milyen kockázati következményekkel fog járni ha bebizonyosodik az, hogy a devizahitelek mögött valójában soha sem volt deviza és így az árfolyam különbözet behajtása valójában egy soha el nem végzett szolgáltatás, ügylet utáni, törvénytelen haszonszerzés. A fent említett perben, meglátásunk szerint a bank a következő jogszabályokat sértette meg, és ez szinte a teljes devizahitelezésre kiterjedhet.

Open Letter to the Organization for the Protection of

the Interests of the Debtors of Hungarian Banks

 

This letter is addressed to the attention of the Hungarian as well as the international media, and we ask the international help of the European Parliament in the examination of the facts contained herein.  Moreover, we ask Russia, as the region’s largest power, to make the utmost effort to enforce her influence to uncover possible infractions of the law.

 

Namely, if, in the foreseeable future, the appropriate legal redress to the flagrant injustices does not come into effect, this could not only affect the internal interests of Hungary but could have an influence beyond the borders of Hungary.  This appeal of ours for international aid arises from the fact that we feel that our organization has done its utmost within the country that the limits of the law allow.

 

In recent years, the banks in Hungary, probably manipulating the situation,  offered the Hungarian citizens credit in Hungarian currency with disadvantageous conditions as compared to the credit in foreign currency, so much so that, in the past five years, virtually everyone borrowed money in foreign currency with „very advantageous” conditions.   These loans were based on the CHF payoff conditions, because, as it has now come to light, these loans were based on the registry of foreign currency payoff conditions.  The banks offering credit, at the time of the disbursement of the credit, actually did not trade in foreign currency and, besides the details of the repayment, they did not have any foreign currency on hand; in other words, they did not deal with the details of the repayment in foreign currency.  These loans have always been in forints; they are disbursed in forints and they are reimbursed in forints, although they are recorded  in foreign currency, so that they might avoid any losses due to the fluctuating currency rates, and these non-existent currency-rate losses are mercilessly passed on to the Debtors.  The credit contracts are purposefully extremely one-sided and unfairly disadvantageous to the Debtors. 

 

The Organization for the Protection of the Interests of the Debtors of Hungarian Banks  (BAÉSZ), already in 2009, on several occasions, appealed in this matter to the Banking Association, the Finance Ministry, the Government, the Consumer Protection Agency and to the leaders of the opposition parties at that time, who since that time have exercised a two-thirds majority in the government.

 

In these appeals, we brought to their attention that the existence of more than a million families was endangered as a result of this extreme deception.  Moreover, at the time of their application for credit, the borrowers were  unable to gauge the true economic condition of the state, which condition had a direct influence on the financial performance, including the possibilities for the repayment of loans.  At the same time, the government at that time tampered with the economic indicators and reported to the media on their collapsing economy.  It is now common knowledge that the Hungarian economic condition was not the cause of the international „economic crisis” but rather the exposed it.  The accidentally-leaked speech of the Prime Minister in Öszöd also proved that they lied day and night in order to hide the true state of the nation from the voters,  including the borrowers, who for ten or twenty years made their decisions in the shadows of these lies.

 

Under Hungarian law, fraud is perpetrated only if the victim is purposefully deceived, kept in this state of deception and experiences continued material losses.   This took place in all the aforementioned cases, but in Hungary, the possibility of so-called political responsibility does not exist, although, according to many people, this should exist in the case of this common, immoral legal crime of fraud.  We do not have at our disposal the official figures or data but we know of several instances of suicide, which took place as a result of this hopelessness, without a determination of any personal responsibility.   Moreover, all our efforts to add to the agenda of the legislation the establishment of institutions to deal with individual bankruptcy were in vain. 

 

The present majority government has done as much as it can to make it advantageous for the banks, and they dealt the final blow to the Debtors by making arrangements to freeze the interest rates, which is only good in that it postpones for three years the agony of those who are on the edge of bankruptcy. The banks introduce the difference of the interest rate into a separate account, laden with interest and, at the end of the fixed period, the Debtors must pay back this difference including interest.  This actually puts more of a burden on them, although it appears to be done to help them and it causes a flood of bankruptcies. So those who might today go into bankruptcy will pay the banks for three more years and, three years later, they will lose everything.

 

Given the virtual differences in the interest rates, the properties assessed by the banks and held in collateral are today no longer assessed at the value of the full amount of the loan; therefore, those properties that the banks turned over to mortgage companies come under the hammer at prices much lower than the market value, so that the Debtor, in a typical scenario, not only loses his property and the already invested capital but is also left with the remainder of the loan in the amount of several million forints.  The banks claim this virtual excess payment by garnishing the wages of the Debtors over a period of several years or decades, since there are no personal bankruptcy institutions.  At the present time, in Hungary, there is no political will to establish such institutions.  This fact proves that there is a mafia-type interdependence of the political strata and the powers-that-be of the financial world.  As a result of such inhumane measures, the Debtors are not only stripped of the fruits of their labors over a period of several years, but also their participation in legal employment, since the garnishment of 30%-40% of their wages makes it impossible to maintain a family.

 

At the same time, in Hungary there is no opportunity for class-action suits, a plan that was rejected by the former President of the Republic to be reconsidered, stating that it presented opportunities for abuse.  He did this on the same day that the law against the denial of the Holocaust was presented and was passed and it was not mentioned that this law would present opportunities for abuse.  Since then, everyone considers this to be extremely important because there are probably more holocaust-deniers in this country than there are victims of the unfair banking practices.

 

Unfortunately, we have to note that the projected law regarding class-action suits was never replaced on the agenda. In the absence of this, our only option is to divide our forces and take up the fight with the banks.  Two years ago, the President of the Organization for the Protection of the Interests of the Debtors of Hungarian Banks (BAÉSZ) initiated a citizens’ suit against the largest bank in Hungary.  Two years later, this suit is still in the stage of determination to see if it is a viable suit.  To demonstrate our prospects, we wish to inform you that the bank comports itself in a malicious way, stalling and obstructing hearings, so that the court itself on several occasions found it in default.  However, there were also several occasions when the respondent (the bank) admitted its fault but, in spite of this, in the interest of fairness, asked the court’s forgiveness, which the Court of Appeals allowed, and the judge ordered that the court costs in this matter be paid by the innocent plaintiff within eight days and did not assure that there would be a right to appeal.  It is our opinion that all this illegality and temporization serve to prevent us for as long as possible from taking the suit to an international court, in the knowledge that, in the wake of a possible crisis, the number of legal possibilities would decrease considerably.

 

We request an international investigation,  as soon as possible, to establish whether the loans based on foreign currency were indeed allotted and, if so, whether the expected and levied rate differences were legal, or if they were just based on fictitious, virtual calculations, which the banks collect in an unending business transaction in an illegal manner, the redemption of which results in undeserved profits for the banks, sending millions of people into a state of hopelessness and reducing them to beggars.  All this takes place with the aid of the government in power.

 

In the absence of the appropriate laws, and the lack of the establishment of new laws, or the unequal administration of the present laws, the common man is deprived of his right to seek justice in an appropriate legal manner.

 

During a period of only one year in trying such a suit, where the courts establish their lack of competency, and quote the lost court documents, the bank can evict the Debtors three times. 

 

It is frightening that, without international pressure and the appropriate investigation of the situation, people are left with no other choice, seeing that the law-abiding conduct sinks into a maze that leads to complete helplessness, in which the desperate situation will call for desperate reactions, and, as a last means of defense, the people are likely to take up the use of force in defense of their families.  The government most probably knows this very well and is therefore spending billions to prevent a crisis, with the establishment of organizations to prevent terror, in a state where terror is an unknown concept, with the exception of the individual act of Matuska Szilveszter in 1931.

 

This open letter, translated into several languages, has been sent to the Prime Minister of Russia, to the European Parliament and to the international media.  The goal is to solicit legal help and at the same time to bring to the attention of those who intend to make business connections with the Hungarian banks in question, that they will be taking risks if it comes to light that, behind the foreign currency based credit, there was never any foreign currency and thus the collection of the difference in rates is really an unending service, an illegal, profit-making business.  In our opinion, in the above-mentioned suit, the bank has violated the following laws including the entire foreign currency laws:
